ICBC

Effective April 1, 2019, the BC government amended the Insurance (Vehicle) Act to add regulations relating to minor injuries. Minor injuries include any of the following:

  • Sprains’
  • Strains
  • Aches and pains
  • Whiplash involving the neck, back, shoulders
  • Cuts/bruises
  • Temporomandibular joint disorder (TMJ)
  • Psychological conditions and concussions or brain injury that does not result in an incapacity

If ICBC determines that your injury is a minor injury:

  • You can challenge the decision at the Civil Resolution Tribunal.
  • This is an online tribunal that assesses written submissions by the parties as opposed to a hearing or a trial.
  • An injury that is deemed to be minor will have a cap on pain and suffering.
